Agreement

This agreement will need to be completed prior to your reservation.
 

Standard Bicycle Flat Tire fee - $10 per incident

E Bike Rear Tire - standard size $15 per incident

Fat tire - $20 per incident

Scooter & Golf Cart Tire Plug fee - $25 per incident

Bicycle and Ebike - Maximum Height 6'2" & Maximum Weight 230lbs

Beach Chairs - Maximum Weight 225lbs

Check your items as soon as you receive them.  you must inform us immediately if an item is not operating correctly.  We do not offer refunds or reduction in rental reservation time after rental items have been received. 

 

Failure to return rental property or equipment upon expiration of the rental period and failure to pay all amounts due (including costs for damages) are evidence of abandonment or refusal to deliver the property, punishable in accordance with Florida Statutes 812.155.  The renter is responsible for all and any damage or loss of equipment and consent to payment of such loss and or damage on the credit card provided to AMI Beach Fun Rentals (AMI BFR LLC).

Any damage to our equipment is your responsibility. Replacement fees per item for... broken or damaged standard chair $25, economy chair $10, umbrella $20, Helmet $25. Lock $10, key $20.  Costs are based on current market value and subject to change. Minor bike damage will be assessed at cost to repair.  Loss or major damage to a bike will require replacement of the bike and you will be charged full retail price to replace it.

Traffic and parking violations must be paid in full prior to leaving the island.  Unpaid fees will incur an additional $50 fee per incident in addition to the violation and any other fees or fines unpaid.

 

I grant the right for AMI BFR to use my likeness or image for promotional purposes related to AMI BFR. I acknowledge and agree that this waiver and release shall be construed pursuant to the laws of the state of Florida. I acknowledge and agree that should any provision or aspect of this release be found to be unenforceable; all remaining provisions of the release and waiver shall remain in full force effect.

 

You have the right to refuse to sign this form and AMI BFR has the right to refuse to let you and or your child participate if you do not sign this form.

Motor Vehicle Rules

  • All drivers of our scooters, golf carts (lsv's) and class 2 ebikes must be at least 21 years of age with a valid driver's license.  Drivers of our class 1 ebikes must be 19 years of age.

  • Follow Florida laws when driving & wear your seat belt.

  • Avoid additional fees and pay in full any and all traffic violations prior to your rental return.

  • Turn signals must be manually turned off after every turn, they do not turn themselves off.

  • You may not drive or park on any sidewalk, bike lane, or any beach on AMI.  You also may not travel over bridges that leave AMI.

  • Do not leave key in ignition when unattended (key replacements are $20.00)

  • If you notice anything is not working on the rental, please contact us immediately.

  • Park and drive your scooter or cart as you would your car.  Obey all local parking rules.  You are responsible for any tickets while you rent this cart. Vehicles Must be parked with directional traffic, all tires off the pavement where permitted and parallel to the street. DO NOT double park or park illegally.  You Must use proper vehicle parking spaces of 1 vehicle per parking spot unless otherwise permitted.

  • Do not drive in heavy rain or through puddles. 

  • Electric Carts… The average range on a full charge is 20 miles to 25 miles.  This will vary based on how fast you accelerate and how much weight is in the cart. The faster speed you drive, the less miles you will get.  Much like the faster you go in your car, the more gas it burns.  You do not need to plug in your cart during the daytime hours unless it is in need a full charge.  Plug in your cart after you are done at the end of every day.  Allow 6 hours without interruption to charge your cart fully from a dead state.  If you are planning a long drive, make sure you have a full charge before you leave.  If your cart is scheduled for pickup at the end of your stay it must have a full charge, or you will be charged $50 for charging and/or recovery fee.  Do not leave key on if you are not driving (it will run the batteries down).

  • Scooter and Golf Cart repair costs are priced as needed at current market prices.

  • Any scooter or golf cart that requires recovery or towing will have a fee up to $150.

Assumption of Risk

PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK
In consideration of the services of AMI BFR LLC DBA AMI Beach Fun Rentals, their agents, owners, officers, volunteers, employees, and all
other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "AMIBFR"), I hereby agree to release,
indemnify, and discharge AMIBFR, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and
estate as follows:
1. I acknowledge that my participation in Electric Bicycles, Bicycles, Golf Carts, Scooters, Kayaking and Paddleboarding activities entails
known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third
parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.
The risks include, among other things: passengers can be jolted, jarred, bounced, thrown about and otherwise shaken during rides; it is
possible that riders could be injured if they come into contact with other passengers or equipment; water hazards; collision with fixed or
movable objects, : accidents involving other scooters, other vehicles or other watercraft; the machine itself may fail; boat capsize and
entrapment; water craft are slippery when wet and accidents can occur getting in or out; forces of nature including extremes of weather,
lightning and rapid weather changes, exposure to sun, strong wind, cold, large waves, eddies and whirlpools, tidal conditions, surf and currents;
cold water shock, hypothermia, hyperthermia (heat related illnesses), heat exhaustion, sunburn, dehydration; additionally, fatigue, chill and/or
dizziness may diminish my/our reaction time and increase the risk of an accident, exposure to potentially dangerous wild animals, insect bites,
and hazardous plant life; aggressive and/or poisonous marine life; wrist, arm, shoulder, and/or back injuries major injuries are a risk as are
bruises, sprains, musculoskeletal injuries including head, neck, and back injuries; further, passengers can be thrown off the vehicle which can
result in any of the above events occurring; accidents or illness can occur in remote places without medical facilities and emergency treatment
or other services rendered; transmissible pathogen or disease ; Traveling to and from activity locations raises the possibility of any manner of
transportation accidents.
Furthermore, AMIBFR personnel have difficult jobs to perform. They seek safety, but they are not infallible. They might be unaware of a
participant's fitness or abilities. They might misjudge the weather or other environmental conditions. They may give incomplete warnings or
instructions, and the equipment being used might malfunction.
2. I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely
voluntary, and I elect to participate in spite of the risks. Additionally, I agree to wear a U.S. Coast Guard approved personal flotation device
(life jacket) while participating in water related activity. I agree to wear a properly fitted and secured helmet while participating in this
activity.
3. I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless AMIBFR from any and all claims, demands, or
causes of action, which are in any way connected with my participation in this activity or my use of AMIBFR’s equipment or facilities,
including any such claims which allege negligent acts or omissions of AMIBFR.
4. Should AMIBFR or anyone acting on their behalf, be required to incur attorney's fees and costs to enforce this agreement, I agree to
indemnify and hold them harmless for all such fees and costs.
5. I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the
costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.
6. In the event that I file a lawsuit against AMIBFR, I agree to do so solely in the state of Florida, and I further agree that the substantive law
of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is
found to be void or unenforceable, the remaining document shall remain in full force and effect.
By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I
may be found by a court of law to have waived my right to maintain a lawsuit against AMIBFR on the basis of any claim from which
I have released them herein. I also agree that this document is valid for subsequent visits and participation at AMIBFR. I have
had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.


PROTECTIVE HEADGEAR REFUSAL AGREEMENT
I, the undersigned, have been fully warned and advised by AMI BFR LLC DBA AMI Beach Fun Rentals
(hereinafter collectively referred to as “AMIBFR”), that I should wear a properly fitted and secured helmet while
participating in AMIBFR (whether on the premises or off of the AMIBFR’s premises) in order to potentially
reduce the severity of an injury and/or to possibly prevent my death from occurring as the result of a fall or any
other occurrence associated with this activity. I understand that by not wearing a helmet, I will be going against
manufacturers’ requirements and putting myself at an increased risk for injuries, and against the advice of AMIBFR
and numerous court cases I am refusing this critical safety precaution. I also understand that minors are not
allowed to refuse protective headgear and I cannot sign on their behalf to waive the requirement.
I, the undersigned, have read the foregoing statement carefully before signing and do understand its
warning.
